Bad River Band Victorious in Enbridge Federal Lawsuit

In a groundbreaking legal decision, Enbridge will be forced to remove the Line 5 crude oil pipeline from the Bad River Band of Lake Superior Chippewa Tribal territory in Wisconsin within three years.

Enbridge and its pipeline have been trespassing on tribal land since its easement expired in 2013. The years-long case that just wrapped up affirms tribal sovereignty while holding Enbridge accountable for not following the law.

Bad River Territory

A $5.1 million penalty for trespassing, plus payments until the pipeline is shut down, must be paid to the Bad River Band. This is a slap on the wrist for Enbridge - just their cost of doing business.

This is a victory, but Enbridge is already threatening to appeal and not comply with this legal ruling. It will spend even more on lawyers to delay any action that would cut its profits.
