Enbridge and its pipeline have been trespassing on tribal land since its easement expired in 2013. The years-long case that just wrapped up affirms tribal sovereignty while holding Enbridge accountable for not following the law.
A $5.1 million penalty for trespassing, plus payments until the pipeline is shut down, must be paid to the Bad River Band. This is a slap on the wrist for Enbridge - just their cost of doing business.
This is a victory, but Enbridge is already threatening to appeal and not comply with this legal ruling. It will spend even more on lawyers to delay any action that would cut its profits.
