Michigan’s year-long study of Line 5 alternatives has been released. Now is the time to submit your comment calling for the only way to truly protect the Great Lakes from an oil spill: decommission the Enbridge Line 5 pipelines through the Straits of Mackinac.

Protect the Great Lakes from a Catastrophic Oil Spill

To the Michigan Department of Environmental Quality, Michigan Agency for Energy, Michigan Department of Natural Resources, and Office of the Attorney General:

I am writing to submit my official comment in response to the State of Michigan’s Line 5 alternatives analysis. This report was expressly commissioned for the overall purpose of “providing the State, Enbridge and the public with information that can be used to help guide decisions for the future of [Line 5 in the Straits].”

I am deeply disappointed in this analysis and this process riddled with conflict of interest. It lacks credibility because Dynamic Risk, a firm with ties to Enbridge, is its author. Even worse, it absurdly underestimates the impact of a spill and ignores a viable alternative to Line 5 – use of existing infrastructure. An expert review in December 2015 by advisors to a Great Lakes policy organization documented the practicality of this alternative.

Decommissioning Line 5 in the Straits of Mackinac is the only alternative that will prevent an oil spill with catastrophic consequences for the Great Lakes and the State of Michigan. It is time for the state to stop delaying action with flawed studies, exercise its legal duty as public trustee, and shut down Line 5. The state should use that authority through enforcement of its easement, an agreement that Enbridge has consistently violated. 

Specifically, the draft report on alternatives to Line 5 in the Mackinac Straits:

  1. Fails to follow the recommendations and standards outlined in the Michigan Petroleum Pipeline Task Force Report and should be withdrawn.
  2. Neglects to provide the state with an independent, fair analysis of the alternatives to Line 5. This report is clearly biased toward allowing Line 5 to continue to operate and/or allowing Enbridge to build new oil infrastructure and further expand its operations. That bias grows out of past, and potentially future, business relationships between Enbridge and the report’s authors. Clearly, the authors are not “wholly independent from any influence by Enbridge,” a standard for establishing credibility in the report’s findings that is outlined in the Task Force Report.
  3. Ignores using existing pipeline infrastructure as an alternative to Line 5 in the Straits, which was one of the alternatives the state required Dynamic Risk to analyze, and leaving it out is in conflict with Task Force recommendation 3 (b). It is unacceptable that the contractor eliminated this alternative in the early stages of analysis, and this must be remedied in the final report.
  4. Does not provide a worst-case scenario spill and cost analysis, which was one of the main objectives of this report and was specifically required by the state in its request for proposals under Section II-B. Instead, Dynamic Risk uses assumptions of risk that are woefully inadequate and are not credible. It estimates that:
    • Only 20-miles of shoreline would be impacted by a spill. This is 3% of the 720-mile area the University of Michigan found vulnerable to a spill in its 2016 study.
    • An oil spill would cost $100 to $200 million when Enbridge’s cleanup costs of its Kalamazoo River Line 6B pipeline oil spill in 2010 cost more than $1.2 billion.
  5. Overestimates an impact to propane supply, greatly exceeding what independent experts have determined would be necessary to provide the Upper Peninsula’s Rapid River facility with an alternative supply. The flawed report finds that up to 35 railcars per week or 15 truckloads per day would be necessary, while another study found it would take only one railcar or 3 - 4 truckloads per day to replace Line 5 propane supply to the U.P.
  6. Shows unfair bias towards building a tunneled pipeline. The report estimates the cost of a tunnel much lower than other estimates for this type of infrastructure; it fails to consider the risk of a spill to the Great Lakes, rivers and streams from other portions of the 64-year-old pipeline if the Straits portion were rebuilt; and it fails to look at the other health and environmental consequences of allowing Enbridge to build a tunnel and further expand its transport of mostly Canadian oil through Michigan for export. Dynamic Risk has a preference for new pipelines, which was evident when the firm aggressively promoted building a tunnel in its proposal to do this report, and its analysis is deeply flawed.

The magnitude of the risk of a spill is too severe to allow Line 5 to continue to operate in the Great Lakes. Michigan should not put the Great Lakes, our economy, health, drinking water, fisheries, and way of life at risk from a catastrophic oil spill any longer.

I urge you to act as legal public trustees of our waters and bottomlands, enforce the ongoing easement violations, and begin the process of decommissioning Line 5 in the Straits of Mackinac to protect the Great Lakes from a catastrophic oil spill. The State of Michigan has an independent legal duty to take this enforcement action based on Enbridge’s ongoing violations.

    All pipelines leak. All pipelines fail. Does Enbridge want to be responsible for a catastrophic environmental disaster that will effect both Canada and the U.S.?

    I do not believe we should endanger our greatest natural resource: clean, fresh water, to support oil production. Future generations will be the ones impacted the most by the decision we make today. I truly hope the State of Michigan will human beings before politics and profits, unlike they did in Flint!

    Please decommission line 5 at the Straits of Mackinaw. A break in the line will be devastating to our fresh water.

    We must do everything to protect the Great Lakes, our source of fresh water to drink. Tell big oil to get out of Michigan, remove or repair existing lines, or get the hell out!

    In a WORLD that is increasingly losing its fresh water systems due to various forms of poisoning, the thought of allowing this Pipeline to cross across wetlands, bogs, aquifers, shorelines as well as UNDER the Great Lakes is unconscionable!!! WATER IS LIFE!!!.. What part of that do you people NOT understand?? ONCE WATER IS GONEYOU CAN NOT get it back!!!!… And once its gone. ALL plants, animals and Humans will also DIE!!!.. PROFIT is nothing compared to LIFE!!!!.. Profits arent life, nor are oils or gas.. We can NOT allow these Oil “Gods” to continue to make billions off of our homes, life sources, resources and RUIN our futures and turn them to waste!!!!… I have children who deserve to grow to live long lives, drink fresh water and love their homes with water surrounding them. As do their future children, and their grandchildren and so forth… Our ancestors took CARE of these things for us too!!!.. Why can we NOT do the same for our Children— Your gold lined pocket books will get you no where. You can not take it to the grave with you. You can not eat money when food is gone. You can not Drink OIL or money when water is gone. You can not LIVE off of money or oil. So why is MONEY, Profit and control of masses by reliance more important to YOU then saving our WORLD for all future generations, Yours included?!! Because what will your loved ones have when Your dynasties have corrupted, polluted, burned, ruined, toxified, maimed it all They will NOT look to you in Honor.. They will look to you in SHAME.. As we all are looking at this entire BIGGER picture in as I type this. My youngest child, 9 yrs old Spoke in front of the State Panel in Petoskey In June. And received a Standing ovation from the entire Room of over 200+ people.. including thank yous and praise from the panel members for her courage to stand and speak for the 1st time in such a large mass. Her and her sister of 12 yr old are my lives carried on. Just as your children are yours. I cant fathom why profit is more important to ANYONE, despite the slave driven society we have been forced to live in that has made Monetary value system more important than life, that you would chose money, profits, and do whatever it takes to get it in the process. No matter whom it affects. So long as it “doesnt affect you”. Oh but this does. When we take a stand you look down upon us.. Because we are in the WAY of your “livlihood, job, profit margins, etc” but in FACT, we ALL care so much we are thinking of you too. This isnt one sided tho our society has made it such. This is global. This is HUMAN. It affects every person of every color of every background and then not just humans. But it affects every eco system, micro system and natural symbiosis system and order on this planet. we are seeing the affects of it at far more rapid paces then natural order of destruction. What humans are doing tho is going to take hundreds of thousands of years to revert from. Natural destruction has an order of rebirth instantly. Ours does NOT. We need to SHUT this line, and inevitably ALL lines down. Shut the OIL EMPIRES down. And all the billionaires from them as well.They wont like that much. Your bosses. People such as yourselves. Change is always scarey. But one must learn to do it to survive. Where we are going there is no survival. We have the abilities to change this.. There are ways Such as what was used Prior to the Oil empires.. HEMP OILS…. Kinda ironic your oil empires sprang up right during the time of the Hemp agricultural industries here in America were being raped from the farmers and people and abolished. Thank you Harry Anslinger, Dupont boys, Winston Churchill and slews of others… For a reason. A reliant people are easily controlled. They dont care. They will risk all our water, our flora and fauna. Our futures for their gain to keep us under their empires business. Without our reliant consumption theyd lose everything. They fear that. SHUT THESE LINES DOWN… Lets begin with LINE 5!!!! Do whats Morally and Humanely correct!!!!!! Not just for us. our loved ones and even ancestors, for our futures and homes, but for your loved ones as well.. If its our purpose in this life to walk in a good way and do good things while we are here, when you go to bed at night, ask yourselves, Have I done the right things today? Have I walked a good path not just for myself but those around me and the earth that gives me and my loved ones Life?.. See what you answer….     Having recently discovered Wilderness State Park; being a guest at a wedding on the shores of Point Nipigon; crossing the Straits to Mackinac Island (one of many, many crossings) I cannot begin to imagine the devastation from an oil spill. Shut it down!
